An Emergency Petition for Writ of Mandamus was filed with the United States District Court, Western District of Texas, Waco Division this afternoon. It was filed by David Koresh, by attorney in fact, Gary D. Hunt, by Gary D. Hunt and Linda Thompson, as next friends, Plaintiffs v. Jeff Jamar of the FBI.

The petition alleges that Jamar is without legal authority in his actions, regarding the actions which have taken place in Waco since February 28, 1993. The allegations include murder, denial of medical attention, interruption of utilities, interception and denial of telephonic communications, torture, harassment and infliction of emotional distress upon Koresh and others within the church complex at Mt. Carmel.

Also alleged are false and fraudulent stories to news media and ridiculing the religious beliefs of the Branch Davidians, as well as denial of access to the press.

Inherent rights, as protected by the constitution, which are alleged to have been denied include those enumerated in Articles One, Four, Five and Nine.

The Mandamus seeks to allow Plaintiffs access to each other for the purpose of allowing communication and consultation during all negotiations and for all legal purposes. A hearing is tentatively scheduled for Monday, March 22.
